Terms of Use

 

Introduction

 

The Ministry of Trade and Commerce is a network of professionals, organizations and companies associated with and supporting the goals of the Global Country of World Peace. When using our web site (the “Site”) or services (the “Services”) you are entering into a legal agreement and therefore agree to the following terms. The Site does not provide medical, investment or legal advice, and no attorney-client relationship is created between users of the Services and the Ministry of Trade and Commerce.

 

1. Purpose

 

Our mission is to promote the goals of the Ministry of Trade and Commerce of the Global Country of World (the “Ministry”), which include a) the removal of global poverty through the application of the programs of the Global Country of World Peace, including Maharishi Vedic Agriculture, and b) the development and promotion of companies, corporations, non-for-profit organizations, and professionals throughout the world who are committed to supporting the programs of the Global Country of World Peace. Our Services are designed to promote economic opportunity and the removal of poverty through the programs of the Ministry by enabling professionals and companies to meet, exchange ideas, learn, find opportunities, and make decisions in a network of trusted relationships.

 

2. Agreement

 

You agree that by registering, accessing or using our Services you are entering into a legally binding agreement (even if you are using our Services on behalf of a company). If you do not agree to this Agreement, do not access or otherwise use our Services.

 

2. Obligations

 

You may use our Services if are eligible to enter into this Agreement and you are at least of Minimum Age.  “Minimum Age” means the age that the law in your country requires you must be for the Ministry to lawfully provide its Services to you (including the collection, storage and use of your information). The Services are not for use by anyone under the age of 13. As between you and others, your personal details belong to you. You agree to follow the law and the participation rules of this Site (the “Rules”). You are responsible for anything that happens with your information posted on this Site. You agree and understand that when you share information, others can see, copy and use that information. You agree that our Services may allow the sharing of your information, and information and content that you share or post may be seen by others. We are not obligated to publish any information or content on our Service and can remove it in our sole discretion, with or without notice to you. The Ministry does not own, develop, endorse, and is not responsible for user content on the Site. The use of a company, individual or entity name in information on this Site should not be construed as an express or implied endorsement by such company or entity of the Ministry or an express or implied endorsement by the Ministry of such company, individual or entity.

 

3. Rights and limits

 

You own all of the content, feedback, and personal information you provide to us, but you grant us a non-exclusive license to it. You promise to only provide information and content that you have the right to share, and that such information you provide will be truthful. As between you and the Ministry, you own the content and information you submit or post to the Site and you are only granting the following non-exclusive license: A worldwide, transferable and sub-licensable right to use, copy, modify, distribute, publish and process, information and content that you provide to the Site, without any further consent, notice and/or compensation to you or others. These rights are limited in the following ways:

 

A.               You can end this license by deleting such content from the Site, except (a) to the extent you shared it with others and they copied or stored it and (b) for the reasonable time it takes to remove it from our system;

B.               We will get your consent if we want to give others the right to publish your posts beyond the Service. However, other visitors to the Site may access and share your content and information, consistent with your degree of connection with them;

C.              While we may edit and make formatting changes to your content, we will not modify the meaning of your expression; and

D.              Because you own your content and information and we only have a non-exclusive right to it, you may choose to make it available to others, including under the terms of a Creative Commons License.

 

You agree that we may access, store and use any information that you provide or post to the Site. You agree to only provide content or information if it does not violate the law nor anyone's rights (e.g., without violating any intellectual property rights or breaching a contract). You also agree that your information will be truthful. The Ministry reserves the right to limit your use of the Services, and reserves the right to restrict, suspend, or terminate your activity on the Site if we believe that you may be in breach of this Agreement or law, or are misusing the Services (e.g. violating any Rules). All Ministry trademarks, service marks, graphics, and logos are trademarks or registered trademarks of the Global Country of World Peace.

 

4. Disclaimer and limit of liability

 

This is our disclaimer of legal liability for the quality, safety, and/or reliability of our Services:

 

TO THE EXTENT ALLOWED UNDER LAW, THE MINISTRY: (A) DISCLAIMS ALL IMPLIED WARRANTIES AND REPRESENTATIONS (E.G., WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NONINFRINGEMENT); (B) DOES NOT GUARANTEE THAT THE SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS; AND (C) PROVIDES THE SERVICE (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS. SOME LAWS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OR ALL OF THESE DISCLAIMERS MAY NOT APPLY TO YOU. TO THE EXTENT PERMITTED UNDER LAW (AND UNLESS THE MINISTRY HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT SUPERSEDES THIS AGREEMENT), THE MINISTRY SHALL NOT BE LIABLE TO YOU OR OTHERS FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITIES, REPUTATION, PROFITS OR REVENUES, RELATED TO THE SERVICES (e.g., OFFENSIVE OR DEFAMATORY STATEMENTS, OR INACCURATE OR INCORRECT INFORMATION). THIS LIMITATION OF LIABILITY IS PART OF THE BASIS OF THE BARGAIN BETWEEN YOU AND THE MINISTRY AND SHALL APPLY TO ALL CLAIMS OF LIABILITY (E.G., WARRANTY, TORT, NEGLIGENCE, CONTRACT, LAW). IF YOU RELY ON ANY INFORMATION ON THIS SITE OR RELY ON ANY INFORMATION PROVIDED BY THE MINSTRY THROUGH THIS SITE, YOU DO SO AT YOUR OWN RISK AND AT YOUR OWN LIABILITY, AND THE MINSTRY BEARS NO RESPONSIBILITY FOR HOW THIS INFORMATION IS USED, FOR CONSEQUENCES ARISING FROM ITS APPLICATION, OR FOR ITS ACCURACY, EVEN IF THE MINISRY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES AND REGARDLESS OF THE THEORY OF LIABILITY.

 

As a condition of using this Site, you agree to indemnify, defend and hold the Ministry, our officers, directors, employees, agents and representatives harmless from and against all claims, damages, losses, costs (including reasonable attorney fees), or other expenses that arise directly or indirectly out of or from: a) your violation of the Terms; b) your use of the Site; and/or c) your violation of the rights of any third party.

 

We may provide links to third-party web sites, and in some cases some of the content appearing to be on this Site is in fact supplied by third parties. The Ministry does not endorse and has no responsibility for the availability or content of these third-party Web sites, which may be governed by terms of use and/or privacy policies, if any, of the applicable third-party content providers. The Ministry shall have no liability or responsibility, directly or indirectly, for any damage or loss caused or alleged to be caused by the use or reliance on any content, goods or services available on or through such site.

 

5. Termination

 

The Ministry or you may terminate this Agreement at any time with written notice to the other. On termination, you lose the right to access or use the Services.

 

6. Dispute resolution

 

In the unlikely event there is a legal dispute between us, it will take place in courts in the Netherlands, applying Dutch law. You agree that the laws of the Netherlands shall exclusively govern any dispute relating to this Agreement and/or the Services.

 

7. General terms

 

If a court with authority over this Agreement finds any part of it unenforceable, you and us agree that the court should modify the terms to make that part enforceable while still achieving its intent and the enforcement of other terms. If the court cannot do that, you and the Ministry agree to ask the court to remove that unenforceable part and still enforce the rest of this Agreement. This Agreement is the only agreement between us regarding the Services and supersedes all prior agreements for the Services. If we don't act to enforce a breach of this Agreement, we agree that that does not mean the Ministry has waived its right to enforce this Agreement. We reserve the right to change the terms of this Agreement, which we will make available on this Site. If you do not agree to these changes, you must stop using the Services. You agree that the only way to provide us legal notice is at the address provided in Contacts.

 

8. Rules of use

 

You agree that you will: 1) Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements; 2) Provide accurate information to us and keep it updated; 3) Use your real name and factual information; and 4) Use the Services in a professional manner.

 

You agree that you will not: 1) Act dishonestly or unprofessionally, including by posting inappropriate, inaccurate, or objectionable content; 2) Create a false identity; 3) Misrepresent your current or previous positions and qualifications; 4) Misrepresent your affiliations with a person or entity, past or present; 5) Misrepresent your identity, including but not limited to the use of a pseudonym; 6) Create a profile for anyone other than yourself (a real person); 7) Harass, abuse or harm another person; 8) Send spam or other unwelcomed communications to others; 9) Scrape or copy profiles and information of others through any means (including crawlers, browser plugins and add-ons, and any other technology or manual work); 10) Act in an unlawful, libelous, abusive, obscene, discriminatory or otherwise objectionable manner; 11) Disclose information that you do not have the right to disclose (such as the confidential information of others; 12) Violate intellectual property rights of others, including patents, trademarks, trade secrets, copyrights or other proprietary rights; 13) Violate the intellectual property or other rights of the Ministry, including, without limitation, using our logos in any business name, email, or URL; 14) Post any unsolicited or unauthorized advertising, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of unauthorized solicitation; 15) Send messages to distribution lists, newsgroup aliases, or group aliases; 16) Post anything that contains software viruses, worms, or any other harmful code; 17) Manipulate identifiers in order to disguise the origin of any message or post transmitted through the Services; 18) Creating or operate a pyramid scheme, fraud or other similar practice; 19) Copy or use the information, content or data of others available on the Services (except as expressly authorized); 20) Copy or use the information, content or data on this Site in connection with a competitive service; 21) Copy, modify or create derivative works of the Ministry, the Global Country of World Peace, the Services or any related technology; 22) Imply or state that you are affiliated with or endorsed by the Ministry without our express consent; 23) Remove any copyright, trademark or other proprietary rights notices contained in or on our Service; 24) Remove, cover or obscure any advertisement included on the Services; 25) Collect, use, copy, or transfer any information obtained from the Ministry without the consent of the Ministry; Share or disclose information of others without their express consent; 26) Use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” the Services or any related data or information; 27) Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages; 28) Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services; 29) Override any security feature of the Services; and/or 30) Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms).

 

9. Reporting a concern about content on this Site

 

If you believe that any content on the Site is in any way unlawful, defamatory, threatening, deceptive, misleading, subject to a confidentiality obligation, or constitutes material, non-public information, notify the Ministry of Trade and Commerce, Global Country of World Peace at tradeandcommerceoffice@maharishi.net.
